Prospects for implementing air quality directives in the Energy Community

Among the acts that introduce instruments and regulations for environmental protection into the Energy Community Treaty instruments relating to air quality protection are clearly missing. This paper examines the options of implementing two EU Directives in the Energy Community – (a) Directive 2008/50/EC of the European Parliament and of the Council of 21 May 2008 on ambient air quality and cleaner air for Europe and Directive 2001/81/EC of the European Parliament and of the Council of 23 October 2001 on national emission ceilings for certain atmospheric pollutants – and determines their suitability for the Energy Community needs.
